These Terms of Service (“Terms”) govern the use of all websites, services, products, platforms, and activities operated by or on behalf of VNAV and its affiliated brands, entities, and subsidiaries (collectively, “VNAV”, “we”, “us”, or “our”), except where separate terms explicitly apply.

By accessing or using any VNAV service, website, or product, you agree to be bound by these Terms.

1. Scope of These Terms

These Terms apply to all VNAV offerings, including but not limited to:

  • Media, production, and creative services
  • Aviation-related activities, experiences, or operations
  • Digital platforms, websites, tools, and online content
  • Consultancy, development, and technical services
  • Events, productions, and on-site activities

VNAV Cloud is explicitly excluded from these Terms and is governed by its own Terms of Service.

If additional or specific terms apply to a particular service, those terms will take precedence in case of conflict.

2. Eligibility & Use

You may use VNAV services only if:

  • You are legally capable of entering into binding agreements
  • You comply with all applicable laws and regulations
  • You use our services solely for lawful purposes

We reserve the right to refuse, suspend, or terminate access to any VNAV service at our discretion.

3. Intellectual Property

Unless stated otherwise:

  • All content, branding, designs, media, software, concepts, and materials provided by VNAV are the exclusive intellectual property of VNAV or its licensors.
  • Nothing in these Terms grants you ownership or licensing rights beyond what is strictly necessary to use the service.

You may not copy, distribute, reverse-engineer, modify, or exploit VNAV intellectual property without prior written permission.

4. User Content

If you submit, upload, or provide content to VNAV:

  • You retain ownership of your content.
  • You grant VNAV a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display the content solely for purposes related to providing or promoting VNAV services.

You confirm that you have all necessary rights to submit such content.

5. Services & Availability

VNAV services are provided “as is” and “as available”.

We do not guarantee that:

  • Services will be uninterrupted or error-free
  • Content will always be available or accurate
  • Any specific outcome will be achieved

We may modify, suspend, or discontinue any service at any time without liability.

6. Liability Limitation

To the maximum extent permitted by law:

  • VNAV shall not be liable for indirect, incidental, consequential, or special damages.
  • VNAV’s total liability, if any, shall not exceed the amount paid to VNAV for the specific service giving rise to the claim.

Use of VNAV services is entirely at your own risk.

7. Indemnification

You agree to indemnify and hold harmless VNAV from any claims, damages, losses, or expenses arising from:

  • Your misuse of VNAV services
  • Your violation of these Terms
  • Your violation of third-party rights or laws

8. Third-Party Services & Links

VNAV services may reference or integrate third-party platforms or services.

VNAV is not responsible for:

  • Third-party content or availability
  • Third-party terms or practices

Your use of third-party services is governed solely by their terms.

9. Termination

We may terminate or restrict access to VNAV services immediately if:

  • You breach these Terms
  • We are legally required to do so
  • We determine continued use poses risk or harm

Termination does not affect rights or obligations accrued prior to termination.

10. Changes to These Terms

We may update these Terms at any time.

Continued use of VNAV services after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands, unless mandatory law provides otherwise.

Any disputes shall be submitted to the competent courts within that jurisdiction.
